Justbet.co.ke MAY MODIFY THIS AGREEMENT AT ANY TIME, AND SUCH MODIFICATIONS SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING OF THE MODIFIED AGREEMENT ON THE SITE. YOU AGREE TO REVIEW THE AGREEMENT PERIODICALLY TO BE AWARE OF SUCH MODIFICATIONS AND YOUR LAUNCHING THE CLIENT APPLICATION, OPENING AN ACCOUNT, USE AND REUSE OF SUCH AN ACCOUNT, PARTICIPATION IN PLACING BETS, OR ACCEPTANCE OF ANY PRIZE SHALL REPRESENT, WARRANT AND CERTIFY THE FOLLOWING TERMS AND CONDITIONS:

DEFINITIONS

i. Force Majeure Event means an event out of control of Justbet.co.ke

ii. Licensor means Justbet.co.ke

iii. You and yours means you, the user of the website.

iv. Your account means the account you will open in order to place bets.

v. Software means (a) all of the contents of the files, disk(s), CD-ROM(s) or other media with which this Agreement is provided, including but not limited to ((i) registration information, i.e. License key which is unique for a registration name of the Licensee; (ii) related explanatory written materials or files ("Documentation"); and (iii) Software setup files and code samples (if any); and (b) upgrades, modified versions, updates, additions, and copies of the Software, if any, licensed to you by the Justbet.co.ke (collectively, "Updates").

vi. Use or using means to access, install, download, copy or otherwise benefit from using the functionality of the Software in accordance with the Documentation.

vii. System means Windows OS, GNU/Linux or Mac OS X, or any virtual machine.

viii. Website means Justbet.co.ke

1. GRANT OF LICENSE

JUSTBET.CO.KE grants you, subject to the terms and conditions, a personal, non-exclusive, non-assignable, and non-transferable license to use the software for the purpose of betting. You may use the software on any computer at which you are the primary user.

You SHALL NOT transfer or sub-license the Licensed Program to any third party, in whole or in part, in any form, whether modified or unmodified.

2. OWNERSHIP

You recognize that the original and any copies of this program made by you, including but not limited to, copyrights and other intellectual property rights, translations, compilations, partial copies, modifications and updates are the property of Justbet.co.ke

You agree not to provide or otherwise make valuable in any form the Licensed Program, or any portion thereof, to any person other than your employees without the prior written consent of Justbet.co.ke.

The system title, all pictures, graphics, photographs, animations, videos, music, audio, texts are protected by copyright laws, any other Law or any International Treaty.

This Agreement and the licenses it grants SHALL NOT be assigned, sublicensed, or otherwise transferred by Licensee without the prior written consent of Justbet.co.ke.

3. RESTRICTIONS

i. You may not modify, merge, revise or enhance the Software in any way.

ii. You may not decompile, disassemble, reverse engineer, or otherwise attempt to discover the Software's source code.

iii. You may not make others to install and/or use the Software by rental, lease, transfer, sub-license, or any other method.

iv. You may not place the Software onto a server so that it is accessible via a public network.

v. You may not export or re-export the Software in any form in violation of any applicable laws and regulations regarding export control of the country in which you obtained them.

Any violators of any of these restrictions will be prosecuted.

ACCOUNT

In order to place bets via this website, you will need to open a JustBet Account. In order to open your account for use with the website, you should follow the instructions on Register Link provided in this website. When registering and opening your account you will be asked to provide your personal information, including your name and appropriate contact details, including an address, telephone number and e-mail address . Your account must be registered in your own, correct, name. You may only open one account with us in relation to the website. Any other accounts which you open with us in relation to the website shall be Duplicate Accounts. Any duplicate accounts may be closed immediately and all transactions made from the duplicate account will be made null and void.

The money in your account shall be used to place bets. You can place as many bets as possible limited by your account balance. Winnings shall be calculated by the use of ODDS. You can’t bet for less than Kshs. 200 or more than Kshs. 5,000 on a particular event.

Deposits sent via mobile money transfer services, will reflect into your account within 2 hours during normal working hours and not more than 8 hours on any particular day.

All Withdrawals are verified on basis of your account balance and your account activities.

Once you send withdraw request, payout of Less than Ksh. 50,000 are processed immediately and sent to you via mobile money transfer. Normally it takes less than 5 hours to process your payment unless adviced from our customer care desk. For identification and clarification purposes, you will have to give Justbet.co.ke a two (2) days notification before you can withdraw sums exceeding Kshs. 50,000.

You hereby acknowledge and accept that, by using the website, there is a risk that you may win or lose money.

USERNAME AND PASSWORD

After opening your account, you must take all reasonable steps to avoid disclosing (whether deliberately or accidentally) your username, password to anyone else. You are obliged to keep your username and password secret and confidential. All transactions made where your username and password have been entered correctly will be regarded as valid, whether or not authorized by you, and Justbet.co.ke shall not be liable for any claims in the event that you disclose your username, password to anyone else.

Any unauthorized use of the username and password due to your recklessness and/or carelessness shall be your sole responsibility. Any liability there from shall be yours.

Should you lose or forget your account details please contact customer care immediately for a replacement.

FRAUD

You agree that you shall not participate in or be connected with any form of collusion, cheating or fraudulent practice, or otherwise any other criminal activity, in connection with your access to or use of the website.

Practices such as colluding, cheating and such like fraudulent activities are not permitted and Justbet.co.ke will take the reasonable steps to detect and stop them. Justbet.co.ke will not be liable for any loss or damage which you or any other player may incur as a result of collusive, fraudulent or otherwise illegal activity, or cheating, and any action we take in respect of the same will be the sole discretion of Justbet.co.ke

Any breach of this paragraph by you will be a material breach of this license and any practice of these fraudulent activities will lead to; your account being suspended for an indefinite period of time; and/or withhold the whole or part the balance of your account; and/or close your account and terminate the terms of use; and/or recover from you any amount achieved through the fraudulent activities.

THIRD PARTY RIGHTS

The software is supplied with and uses third party software or materials which are governed by their own separate license agreements (Separate Files). This license does not apply to such Separate Files and they are not included in the term Software under this License. The Licensee agrees to co.keply with all terms and conditions imposed on you in respect of such Separate Files.

EVENTS OUTSIDE OUR CONTROL

Justbet.co.ke will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under this license that is caused by a Force Majeure Event.

Justbet.co.ke’s performance is deemed to be suspended for the period that the Force Majeure event continues, and will have an extension of time for performance for the duration of that period. Justbet.co.ke will use its reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure event.

ENTIRE AGREEMENT

This agreement takes precedence over any previous agreements, discussions and undertakings whether express or implied concerning the terms in the agreement. This agreement shall also take precedence over any additional or conflicting terms which may be contained in the purchase order or Justbet.co.ke’s acknowledgement forms.

NOTICES

All notices with regard to this agreement shall be in writing and may be given by certified, registered, or first class mail or personally delivered at the address set forth on the front page. A notice shall be deemed effective upon personal delivery to the party or if by mail five days after proper deposit in a mail box.

RESERVED RIGHTS

JUSTBET.CO.KE reserves the right to;

i. Admission with notification.

ii. Cancel this license at any time without prior notice.

iii. Change this license agreement and the terms and conditions from time to time. You will be notified of any changes prior to the use of the software.

All rights not expressly granted here are reserved to Justbet.co.ke reserves the right to make exceptions to any of these conditions, at any time.

SEVERABILITY

Should any provision of this agreement be rendered invalid or unenforceable the reminder of this agreement shall remain in force as if such provision were not a part.

GOVERNING LAW

The law governing this Agreement is the Kenyan Law and the Kenyan courts will have the jurisdiction to hear and settle any dispute that may arise between the parties.

SPECIAL TERMS AND CONDITIONS.

1. Clients must be over 18 years of age.

2. The minimum bet is Kshs. 200/=

3. The maximum bet is Kshs. 10000/= per bet and on a particular Game/Event.

4. You can place as many bets on a particular Game/Event as long as it does not exceed the maximum of Ksh. 10,000/= for the particular game.

5. The maximum amount of money you can maintain in your account is Kshs. 100,000/=

6. The Maximum Winnings per day is Kshs. 100,000/=

7. You cannot combine a Multi-Bet of the Same Game/Event.

8. Bets placed cannot be cancelled or altered.

9. The odds on website display or on our promotional printed posters may vary with the odds you may be placing bets on. It is the responsibility of the client to confirm the new odds when placing a bet.

10. Betting for the game listed stops at kick off. Even if the Place Bet button maybe active, any bets placed after kick off will considered void.

11. You cannot bet where the outcome is known.

12. The client is responsible for the secrecy of his own account number and passwords. Bets placed by third parties, aware of these details will be considered valid.

13. If any sum is erroneously credited to the client's account all subsequent bets directly or indirectly arising from this mistake shall be cancelled.

14. In the event of disputes not settled by the parties, it is possible to turn the matter over to IBAS (Independent Betting Arbitration Service). The arbitrator's decision is binding on both parties.

15.The abuse of a software bug in our betting system is illegal. Justbet.co.ke shall take all necessary measures in case of a use and/or abuse of a bug from a Player, such as blocking of the Player Account, freezing of the funds and eventually the institution of legal proceedings.
